Privacy Policy

This Privacy Policy explains how Danyon Goodermote, doing business as MarketWell Labs ("MarketWell Labs", "we", "us") collects, uses and shares information when you visit marketwelllabs.com, contact us, or use our marketing services, including when you connect your Facebook, Instagram, Google or WordPress accounts to our platform.

1. Information we collect

Information you give us

• Contact details such as your name, business name, email address, phone number and website when you email us or request a preview.
• Business information you provide for your marketing, such as services, offers, photos, brand colors, target audience and budgets.
• Billing information if you become a client. Payments are processed by our payment provider. We do not store full card numbers.

Information from connected accounts

If you are a client and choose to connect an account, we receive access tokens and the data needed to provide the service:

• Meta (Facebook, Instagram, Meta Ads): the Facebook Pages, Instagram business accounts and ad accounts you select; the ability to publish posts and create, pause and adjust ads; and ad performance data (spend, impressions, clicks, results).
• Google Business Profile: the business locations you select; the ability to publish updates; and your reviews, so we can reply to them.
• WordPress: the site address, username and application password you provide, used to publish articles.

Information from public sources

To prepare marketing previews, we may review a business's public website, including text, colors and images, and publicly available information about the business. We only use this to prepare marketing materials for that business.

Website data

Our website does not use advertising or tracking cookies. Our hosting provider may keep standard server logs (such as IP address, browser type and pages requested) for security and reliability.

2. How we use information

• To provide our services: researching your business, creating and publishing content, running and optimizing ads within your budget, replying to reviews, publishing articles, and reporting results.
• To prepare a free marketing preview when you or we reach out about working together.
• To communicate with you, including service updates, reports, invoices and replies to your questions.
• To keep our services secure, prevent abuse, and meet legal obligations.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

3. How we use artificial intelligence

We use AI models from service providers to help write marketing copy, plan content, describe photos, generate images and videos, and draft review replies. Information about your business (for example your services, offers and photos) is sent to these providers to generate this content. Our providers process this data on our behalf under their business terms. We do not use your connected-account data to train AI models.

4. Google user data

Specifically, data we receive from Google Business Profile (your locations, reviews and posts):

• is used only to provide and improve the features you use: publishing your updates, replying to your reviews, and reporting on them;
• is not transferred to others except as needed to provide these features (for example, sending a review's text to our AI provider to draft a reply), to comply with law, or as part of a merger or acquisition with notice to you;
• is not used for advertising, is not sold, and is not used to train AI models;
• is not read by humans except with your consent, for security or abuse investigations, to comply with law, or when aggregated and anonymized for internal operations.

5. Meta platform data

We use data from Meta's platforms only to provide the services you've asked for (publishing to your Pages and Instagram accounts, and managing your ads) and to report results to you, in line with Meta's Platform Terms. You can remove our access at any time in your Facebook settings under Business Integrations, or by asking us. See our data deletion instructions.

6. How we share information

We share information only with:

7. How long we keep information

We keep client information while you're a client and for up to 90 days afterward so you can export anything you need, unless you ask us to delete it sooner. Access tokens are deleted as soon as you disconnect an account or ask us to. We keep invoices and records we're legally required to keep for as long as the law requires. Preview materials for businesses that don't become clients are deleted within 12 months, or sooner on request.

8. Security

Access tokens for connected accounts are encrypted at rest, and our systems are restricted to authorized people. No method of storage or transmission is 100% secure, but we work to protect your information and will notify you as required by law if a breach affects you.

9. Your choices and rights

You can ask us to access, correct, export or delete your personal information, or to stop contacting you, by emailing danyongood@marketwelllabs.com. Depending on where you live (for example California and other US states with privacy laws), you may have additional rights, including the right to know what we collect and the right not to be discriminated against for using your rights. We will verify your request and respond within the time the law requires. You may use an authorized agent to make a request.

If you receive an email from us that you don't want, reply "unsubscribe" or use the opt-out line in the email and we will stop.

10. Children

Our services are for businesses and are not directed to children under 16. We do not knowingly collect personal information from children.

11. International users

We are based in the United States and process information there. If you contact us from elsewhere, you understand your information will be processed in the United States.

12. Changes

We may update this policy. If we make significant changes, we will post the new version here with a new effective date and, for clients, notify you by email.
